In accordance with articles 16 and 17, section II of the Federal Law on the Protection of Personal Data in Possession of Private Parties (hereinafter, “Data Protection Law”), and in order to ensure the privacy and the right to self-determination of our clients and/or the individuals who have decided to share their personal data with us, please be informed as follows:
Identity and address of the data controller
Martínez Suárez & Cavazos Flores (hereinafter, “MSCF”), which is domiciled at Avenida 16 de Septiembre 730-803, Col. Mexicaltzingo, C.P. 44180, Guadalajara, Jalisco and whose telephone number is (33) 3613-3397, would like to inform its clients, website users, and any other individual who, prior to giving his or her consent, has voluntarily assigned his or her personal data using various media, which include, inter alia, the digital environment, correspondence, business cards, phone calls, etc., that MSCF will be the sole data controller regarding the processing, use, storage, and disclosure of his or her personal data.
Purpose for processing personal data
MSCF will hold the personal data in order to carry out the firm’s general management activities so that it may provide legal services; make contact with the individuals requesting this using the means of communication available at the time at which they are collected, whether for the purpose of answering a request or providing information regarding legal services; or, as the case may be, respond to the job applications received by the firm. In addition, and after MSCF has collected the personal data, they will be used by the firm’s general management for compatible purposes.
Options for limiting the use or disclosure of your personal data
You may personally limit the use or disclosure of your personal data at the address provided above or by submitting a request to the e-mail address provided. MSCF pledges to keep the data it collects confidential, even after the relationship it has with the data subject comes to an end.
Means for exercising the rights of access, rectification, erasure, or blocking of the consent to personal data processin
You may revoke your consent for the processing of your personal data in the same manner as that which is provided in the previous section for limiting the use or disclosure thereof. You have the right to: (i) access your personal data in our possession and be informed of the details regarding how they are being processed; (ii) rectify them in the event they are inaccurate or incomplete; (iii) cancel them when you are of the opinion that they are not required for one of the purposes specified in this Privacy Notice, if they are being used for unauthorized purposes, or if the contractual relationship or the services have concluded; or (iv) block their processing for specific reasons in accordance with law. In order to exercise your rights, you must send or have sent the following to MSCF using electronic means, to the e-mail addresses provided, or by physical means to the company’s address:
- a. Name, address, and e-mail address or address of the contact;
- b. A copy of the documents that serve as evidence of your identity (voter identification card (IFE), passport, or any other official identification) or, as the case may be, of the documents that serve as evidence of the identity of your legal representative, the original version of which must be submitted in order to obtain an answer from the Data Controller;
- c. A clear and accurate description of the personal data with respect to which you are attempting to exercise one of the aforementioned rights;
- d. Any document or information that aids in locating your personal data; and
- e. When requesting the rectification of your personal data, you must also specify the changes to take place and provide the documents supporting your request.
MSCF must answer your request via e-mail or physical means at the address provided by you no later than 30 business days from the date on which the request is received. If the answer to the request is affirmative or that it is appropriate, the requested changes shall be made within no later than 15 business days. MSCF may notify you within the periods indicated in this paragraph that they have been extended—on only one occasion and for a period equal to the original period.
MSCF may refuse the request made in the events provided for by law, in which case it must inform the requester of the reason for such decision. The refusal may be partial, in which case the Data Controller shall carry out the relevant access, rectification, erasure, or blocking. The rights indicated at the beginning of this section shall be exercised free of charge. The requester must pay for justified delivery costs or the costs for reproducing as copies or using other formats, as well as the cost for document certification, if any.
Transferral of personal data
Personal data collected by MSCF will not be assigned, sold, shared, or transferred without informing you in advance and obtaining your prior consent, or unless one of the events provided for in the Data Protection Law or its regulations occurs. However, MSCF reserves the right to share your personal data with the firm’s employees and partners, as well as with those who must come into contact with them in connection with the provision of services. It should be noted that all third parties processing your personal data will do so on behalf of MSCF.
Changes to the Privacy Notice
The use of our website implies your acknowledgment and acceptance of this Privacy Notice, which contains the date it was last modified at the end. Pursuant to the foregoing, MSCF reserves the right to change the terms and conditions of this Privacy Notice such change will be published on our website, www.mscf.mx, and all interested parties will have access to this site. In any case, we recommend that you review this Privacy Notice each time you access our website in order to familiarize yourself with changes, modifications, and updates to it. In the event of any security breach during any stage of personal data processing that significantly affects your economic or moral rights, MSCF will immediately notify you via e-mail of such security breach so that you may take the corresponding necessary measures in defense of your rights. If we do not have your e-mail address, the notice will be published on our website. This Privacy Notice is governed by the Data Protection Law, its regulations, and other applicable Mexican legal provisions, and your acceptance implies your express submission to the courts of Guadalajara, Jalisco regarding any dispute or claim in connection herewith.
